Terms of service

1. Agreement to these terms

By using this website or placing an order with Sydney Lifting Equipment Pty Ltd (SLE, we, us), you agree to these Terms of Service. If you do not agree with them, do not use the site.

2. Who can use this site

You need to be able to form a legally binding contract to use this site, and the information you give us when creating an account or placing an order needs to be accurate and current. If your details change, update them or tell us.

3. Product descriptions and technical specifications

We describe our products and publish technical specifications as accurately as we can, and we stand behind what we write. If a description turns out to be wrong, that is on us to fix, not something we disclaim responsibility for. If you are unsure whether a product suits your application, ask before you buy.

4. Prices

All prices on this site are in Australian dollars and include GST unless stated otherwise.

5. Orders, acceptance and cancellation

Placing an order is an offer to buy. We accept that offer when we confirm and process your order, or when we dispatch it, whichever happens first. We can decline or cancel an order before dispatch, including for pricing errors, stock issues, or if something about the order looks like fraud. If we cancel an order you have paid for, we will refund you in full.

6. Stock availability

We aim to keep stock levels accurate, but stock can move between when you order and when we process it. If an item is unavailable, we will contact you with options: wait, substitute, or refund.

7. Payment

Payment must be made using a payment method offered at checkout. Payment processing may be provided by Shopify or another payment service provider and is subject to the applicable provider terms and privacy practices.

8. Shipping and pickup

See our Shipping and Delivery Policy for how freight, carrier selection and pickup work.

9. Requested order changes

If you need to change an order after placing it, contact us as soon as possible. We will do what we can, but once an order has been processed, packed, cut, or dispatched, changes may not be possible.

10. Made-to-order, special-order and cut-to-length goods

These items are produced or sourced specifically for your order. Once work has started, cancellation or change-of-mind returns are not available for these items. Your rights for a faulty, unsafe or incorrectly supplied item are unaffected.

11. Correct product selection, installation and use

You are generally responsible for selecting the correct product for your application, including working load limits, materials compatibility, and relevant standards. Lifting, rigging and load-restraint equipment carries real safety consequences if used incorrectly.

This does not reduce our obligations where you tell us the purpose you need a product for or the result you need it to achieve, where you reasonably rely on our advice or product recommendation, or where we represent that a product is suitable for a particular purpose. In those cases, we remain responsible for that advice or representation under the Australian Consumer Law.

If you are not sure a product is right for the job, ask us before you buy or before you use it.

12. Technical assistance and its limits

Our team can help you choose the right product and answer questions about specifications. Where that assistance amounts to advice or a recommendation for a purpose you have told us about, section 11 applies. General technical assistance does not replace a competent inspection, engineering assessment, or a properly qualified lifting or rigging procedure for your specific job. Where a job needs sign-off from a qualified person, get that sign-off.

13. Intellectual property

The content on this site, including text, images, logos and product descriptions, belongs to SLE or its licensors. You may not copy or reuse it without our permission.

14. Prohibited conduct

You must not use this site to do anything unlawful, to interfere with its operation, or to misuse another customer's information.

15. Third-party services and links

This site may link to or use third-party services, including payment and shipping providers. We are not responsible for the content or practices of third-party sites.

16. Privacy

Our Privacy Policy explains how we collect, use and store your personal information.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

18. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. This includes your right to compensation for reasonably foreseeable loss or damage caused by our failure to meet a consumer guarantee.

Where legally permitted, we do not accept liability for loss or damage caused by misuse, unauthorised modification, incorrect installation, use outside a product's published specifications, or failure to follow applicable safety requirements.

Nothing in this clause excludes or limits our responsibility for our own product descriptions, advice, negligence, or other statutory obligations.

19. Governing law

These Terms are governed by the laws of New South Wales, Australia.

20. Complaints and contact

If something is not right, contact us using the details on our Contact Information page. We would rather sort it out directly than have you chase us through three departments.
